2. Purpose and nature of the site

The Sóller Action Plan monitoring platform (hereinafter, "the platform") is the digital tool through which the Ajuntament informs the public of the progress in implementing the measures set out in the Action Plan, which was drawn up on the basis of the participatory process "The Sóller Resident's Vision".

The platform is purely informative and participatory in nature. It is not an electronic office (sede electrónica) within the meaning of Article 38 of Law 40/2015 on the Legal Regime of the Public Sector, and it does not allow the submission of applications, written submissions, complaints, appeals or any other administrative procedure. These must be carried out through the Ajuntament's electronic office or by any of the means provided for in Article 16.4 of Law 39/2015 on the Common Administrative Procedure of Public Administrations.

3. Terms of use

Access to the platform and consultation of its content are free of charge and unrestricted, and do not require registration. Accessing the platform makes you a user and implies acceptance of this legal notice.

Posting comments requires first creating a participant account, which is restricted to persons aged 18 or over, and accepting the participation rules. Users undertake to use the platform in accordance with the law, good faith, public order and these terms, and not to use it in any way that may damage, disable or overload the site or prevent its normal use by others.

4. Nature of the published information

Information on the status, degree of progress and timescales of the measures is prepared by the municipal departments responsible for each measure and by the Plan's technical monitoring team, and is updated periodically. The date of the last update is shown at the foot of each page.

The progress indicators serve the purposes of accountability and transparency and constitute monitoring estimates. They have no legally binding value and do not replace administrative acts, agreements and resolutions, which are the only instruments that produce legal effects and which are published through the relevant official channels (electronic office, notice board and official gazettes). In the event of any discrepancy, the information published through those official channels shall prevail.

5. Intellectual and industrial property

All content on the platform (texts, data, graphics, maps, design, structure, source code, logos and other distinctive signs) is owned by the Ajuntament or by third parties who have authorised its use, and is protected by intellectual and industrial property legislation. All rights reserved.

Consultation and brief quotation for informational, teaching or research purposes are permitted, provided that the source is acknowledged and the meaning is not distorted. Any other reproduction, distribution, public communication or transformation, in whole or in part, requires the express written authorisation of the Ajuntament.

Published comments are the work of their authors, who retain ownership of them. By publishing them, authors authorise the Ajuntament to disseminate them on the platform free of charge and for the retention period set out in the privacy policy.

The platform may contain links to third-party websites. The Ajuntament does not control these sites and accepts no responsibility for their content, privacy policies or availability. The inclusion of a link does not imply any kind of endorsement of, or association with, the owner of the linked site.

7. Liability

The Ajuntament endeavours to ensure that the published information is accurate, up to date and available, but cannot guarantee that it is free of errors or that the service will operate without interruption, as it may be temporarily suspended for maintenance, updates or security reasons.

Published comments express solely the opinions of their authors, who are responsible for them, and do not represent the position of the Ajuntament. The Ajuntament moderates them in advance in accordance with the participation rules.

All of the above is without prejudice to the system of financial liability of public administrations established in Law 40/2015 on the Legal Regime of the Public Sector.

8. Information security

The Ajuntament applies to this platform the security measures provided for in Royal Decree 311/2022 regulating the National Security Framework (ENS), in accordance with the category of the system.

9. Amendments

The Ajuntament may amend this legal notice to adapt it to regulatory or functional changes to the platform. The version in force is always the one published on this page, showing the date of the last update.

10. Applicable law and jurisdiction

This legal notice is governed by Spanish law. Disputes arising from the use of the platform that fall within the jurisdiction of the contentious-administrative courts shall be submitted to the competent courts and tribunals of that jurisdiction, in accordance with Law 29/1998 regulating the Contentious-Administrative Jurisdiction.
